Before you call

What happens when you ring this office

  1. You describe what happened, in your own words. There is no form to fill in first and nothing to pay.
  2. You will be asked for dates: when the accident happened, when you were first seen by a doctor, and whether anything has been signed or recorded. Those three answers usually determine what is possible.
  3. You will be told whether this is a matter this office should handle. If it is not, you will be told that plainly, on the same call.
  4. If it is, what happens next is explained before you agree to anything, and the fee agreement is in writing.

Useful to have in front of you

  • The crash report or the exchange-of-information slip.
  • Your own auto insurance declarations page — the page listing your coverages, including uninsured motorist.
  • The names of anywhere you have been treated.
  • Photographs, if you took any.
  • Any letter, email or text an insurance company has sent you.

If you have none of that, call anyway. Most people start with nothing but the date.

One thing not to do

Do not give the other side’s insurer a recorded statement before you have spoken to a lawyer. Since Florida’s 2023 comparative-fault change, a share of blame attached to you early can reduce — or, above 50 per cent, eliminate — a recovery entirely (Fla. Stat. §768.81(6)).

Finding the office

The main entrance carries 1700 on the glass, and there is parking directly in front of it. Through those doors is the lobby pictured here. Waggener Law is Suite 203.

The office is open Monday to Friday, 9:00 a.m. to 5:00 p.m. The phone is answered 24 hours a day, every day — so if the accident happened at two in the morning, call at two in the morning.

If getting here is difficult — if you are injured, without a car, or out of the area — it does not need solving first. The opening conversation happens on the phone.
